Designated Employer Representative Training
To properly administer the Drug Free Workplace Program, each signatory
contractor must designate an employer representative. The Designated
Employer Representative (DER) can be a:
• Safety director
• Human resources personnel
• Manager, or
• Any other responsible person trusted with confidential information.

and maintain a viable drug testing program. The company’s principals
are Peter Bensinger, who served as administrator of the Drug Enforcement
Administration, and Dr. Robert DuPont, the founding Director of the
National Institute on Drug Abuse.

Initial or Start-Up Testing
The DER will be responsible for distributing a Test Authorization
Form to every existing union employee for his or her initial drug test.
The distribution of Test Authorization Forms for initial testing does
not need to be confidential and is not as time sensitive as other reasons
for notification. It is important, however, to make sure that each person
is aware of his/her need to test within the start-up period.

Random Drug Testing
The DER will receive notice of employees selected for random drug
testing from the Plan Manager and will need to respond. Following is
the random drug testing process:
1. You will be sent notification of random selections by an email from
the Plan Manager.
2. The person(s) selected for a random test need to be notified of their
need to test as soon as possible.
3. If a person selected for a random test is no longer working for you,
immediately (same day of receipt) reply to the Plan Manager’s
email with this response.
4. Random notices are spread throughout the month; you may receive more
than one notice of selections within a month.
5. Notice of a random selection must be given to an employee in such
a manner that you can document the date and time the person was notified.
Usually, this is noted on the Test Authorization Form.

Check on the Member in Good Standing Status of Employees
The DER will access the employee database to confirm the Good
Standing status of employees.
The DER must always check the status on new hires.
The DER must check the status on current employees after you have sent
them for a drug test. Information regarding a test is usually available
within 24-48 hours.

A username and password will be provided to you once you have registered
as your company’s DER.

Member NOT in good standing
Any member who is not in Good Standing with the Program must be
immediately removed for their duties.
An employee may not be in good standing for any of the following reasons:
1. They have refused to take a test. This includes: a person not taking
a test within the time allowed following notification; a person not
staying at a collection facility to finish the collection process once
it has begun; a person not cooperating with collection site personnel.
2. A positive drug or alcohol test.
3. Non-compliance with recommended treatment following a refusal to
test or a positive drug or alcohol test.
The DER will receive phone calls and/or emails from the Plan Manager
regarding employees who are not in good standing with the Program.
The Program’s success is dependent on timely and confidential
communication between you and the Plan Manager.

Member Assistance Program (MAP)
Any member who has failed or refused a drug or alcohol test will
be referred to the Member Assistance Program (MAP) by the Plan Manager.
A member must participate in any treatment recommended by the MAP before
they can return to work.
A member must pass a Return to Duty drug test before they can go back
to work.
After returning to work, the member may be subject to follow-up testing
as recommended by the MAP.

Recordkeeping
Maintain all information in a confidential manner, sharing with
management on a need-to-know basis.
Keep Drug Free Workplace records separate from other personnel records.
